The Nice Classification system divides trademarks into 45 international classes based on goods and services. Established by the Nice Agreement in 1957 and maintained by the World Intellectual Property Organization (WIPO), this system is used by the USPTO and trademark offices in over 150 countries. Classes 1 through 34 cover goods, while Classes 35 through 45 cover services.

Understanding the Nice Classification System
The Nice Classification is the international standard for categorizing goods and services when filing trademark applications. When you apply to register a trademark with the USPTO, you must specify which class or classes your mark covers. Choosing the correct class is critical because trademark protection only extends to the goods and services listed in your registration.
A single trademark application can cover multiple classes, but each additional class requires a separate filing fee. Many well-known brands file in several classes to protect their mark across different product lines and services. For example, a technology company might file in Class 9 (software), Class 35 (business services), and Class 42 (SaaS and IT services).
The Nice Classification is updated annually by WIPO to reflect evolving industries and new types of goods and services. The current edition includes detailed listings of acceptable identifications of goods and services for each class, helping applicants accurately describe what their trademark covers.
